Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the Fetcher™ Opportunity Finder™ website at https://opportunityfinder.runfetcher.com/ and the services made available through it (the "Services").

Fetcher™ is a business opportunity intelligence capability operated by 32AiM™ Technologies™ ("32AiM™", "we", "us", or "our").

By accessing or using the Services, you agree to these Terms on behalf of yourself and the business you represent. If you do not agree to these Terms, do not access or use the Services.

Fetcher™ helps businesses identify and prioritize potential opportunities using available market, behavioral, intent, and business signals.

The Services include three complementary capabilities:

Find New Opportunities™ (FIND): helps identify and prioritize potential people or businesses that may align with your Opportunity Profile™ within the broader market.

Recognize Website Visitors™ (RECOGNIZE): where available and appropriately configured, explores whether available recognition data may help make a portion of otherwise anonymous website traffic more understandable and actionable.

Enrich Existing Data™ (ENRICH): evaluates existing customer, prospect, and lead records to help fill selected gaps, improve segmentation, and uncover potential reactivation opportunities.

These capabilities support the operating principle: DEFINE → FETCH → PRIORITIZE → ACT.

The Fetcher™ Opportunity Test is a one-time, introductory engagement priced at $497 USD.

It covers only the scope expressly agreed upon between you and 32AiM™. Find, Recognize, and Enrich are not automatically bundled together, and a single $497 engagement does not include all three.

Scope and deliverables are mutually agreed before payment. We will review your request, confirm the proposed scope and deliverables with you, and provide secure payment instructions only after the scope has been mutually agreed upon.

Available data, matching capabilities, and deliverables vary by the selected opportunity type. No long-term commitment is required, and there is no recurring subscription.

Fetcher™ identifies and prioritizes potential opportunities using available data, signals, and defined criteria.

Fetcher™ does not guarantee leads, customers, appointments, sales, revenue, conversions, match rates, identification rates, or return on investment. Results vary based on market, audience, geography, data availability, matching, qualification, and other factors.

Industry benchmarks shown in the Customer Economics Calculator™ are sourced from independent third-party research and are provided for educational comparison only. They do not represent Fetcher™ performance or guaranteed acquisition costs.

Website recognition is not guaranteed to identify every visitor, establish the identity of a particular person, or establish permission to contact that person.

You are responsible for the accuracy of the information you submit through forms, assessments, calculators, and the Opportunity Profile™.

You are responsible for using Fetcher™ information, including any recognized visitor or enrichment data, in accordance with applicable privacy, marketing, and communications laws, and for obtaining any required consent before contacting individuals or businesses.

Fetcher™ information reflects potential opportunities and available matching results; it does not establish permission to contact anyone.

You agree to use the Services for lawful business purposes only and not to use the Services in a manner that is misleading, deceptive, or that violates the rights of any third party.

Our collection, use, disclosure, and protection of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

Payment card information may be processed by an authorized payment provider rather than stored directly by Fetcher™.

Information you submit, including Opportunity Profile™ answers and calculator assumptions, may be used to develop your opportunity assessment and deliver the agreed Services.

You agree not to: misuse the Services, reverse engineer or attempt to discover underlying technology, sources, or providers; resell or redistribute Fetcher™ information without authorization; or interfere with the security or operation of the Services.

We may suspend or terminate access where we reasonably believe these Terms or applicable law have been violated.

All content, software, branding, trademarks, service marks, logos, designs, methodologies, reports, and other materials made available through the Services — including the Fetcher™, Retriever™, Uply™, and 32AiM™ marks — are owned by or licensed to 32AiM™ Technologies™ and are protected by applicable intellectual property laws.

Fetcher™, Retriever™, Uply™, 32AiM™, and related names and marks are trademarks or service marks of 32AiM™ Technologies™. You may not use these marks without prior written authorization, except to identify the Services as offered by 32AiM™.

You retain ownership of the information and records you submit to Fetcher™. Opportunity intelligence, matched results, enrichment data, and other outputs generated by Fetcher™ are provided for your internal business use under these Terms and may not be resold, redistributed, or repackaged without authorization.

You may not copy, modify, distribute, reverse engineer, decompile, or attempt to discover the underlying technology, sources, providers, or methodology of the Services, except as expressly permitted by these Terms or applicable law.

Third-party industry benchmarks referenced in the Customer Economics Calculator™ remain the property of their respective publishers and are cited for educational comparison only.

The $497 Opportunity Test is a one-time fee. No recurring subscription is created unless separately agreed in writing.

Any additional or ongoing services, quantities, delivery methods, or activation options are priced separately and agreed in writing before payment.

Payment instructions are provided only after the scope and deliverables of a paid engagement have been mutually agreed upon.

The Services are provided on an "as available" basis. To the fullest extent permitted by law, the Services are provided without warranties of any kind, whether express or implied.

32AiM™ does not warrant that the Services will be uninterrupted, error-free, or that any particular opportunity, match, or result will be achieved.

To the maximum extent permitted by law, 32AiM™ aggregate liability arising out of or relating to these Terms or the Services shall not exceed the amount you paid to 32AiM™ for the specific engagement giving rise to the claim.

These Terms remain in effect while you use the Services and thereafter with respect to any information, records, or deliverables provided.

We may modify or discontinue any aspect of the Services with reasonable notice where practicable.

Either party may terminate a paid engagement as set out in the applicable written agreement for that engagement.

We may update these Terms to reflect changes in our Services, practices, or legal obligations. Material changes will be communicated where required.

Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
